Delay in handing over of Flat

Dear All,

I have booked for a Flat in Desai Homes on 2006,
Project name: Golden gate
Work of the flat is still in progress and the same has been not handed over to me as promised by the builder (they have promised to deliver on 2008)
i have given full amount to builder.
Flat no: is 107-I,

pls do something........

We are also facing similar situation in Desai Home's another project in Kaloor, namely Platinum Planet.
A good idea is to get all the owners in your apartment together. This is possible through a platform called commonfloor as per link below.

Desai Homes worst building group i ever met . I paid full amount for flat in their platinum project in 2006 promising a delivery in 2008 ,till now, forget getting the flat, not even my sale agreement,sales manager mr.ragesh won,t pick up the phone general manger lukochen is so busy never in the office ,who knows the director ?

Dear Dr.Rommy,

You have complained that I have not picked your calls. In fact I was on a business trip abroad ( in Saudi Arabia) during this period I couldn't pick your calls.Otherwise I had always picked your call or returned your calls. Moreover you have complained that you have not received the Sale Agreement. We had already given you the sale agreement to you much earlier and you have even commented on the agreement.please do not make such baseless allegations.

My apartment @ Desai Golden Gate which I paid full amount 3 years back is yet to be completed.

We booked our Flat in DD Golden Gate in 2007. Company promise us to gave delivery in September 2008. But there is no progress in this project and company is not taking any interest to complete the project. They are cheating the clients.

they have not completed any property that they staretd after 2005. It is a matter of time desai management be caught by police for cheating and start facing legal issues. On top of that, GOD is not going to forgive them for cheating customers in big time.

Hi All,

I am a regular investor of Desai Homes, from 1st project DD Village,- Thammanam till the latest project Misty Hills. As all of you commented they had delayed 3 projects, Platinum, Golden Gate & Samudra Dharshan. But they are not cheaters, because i started dealing with them from 1992 onwards. Now they started handing over in Platinum & Golden gate. After 2005 they delivered DD Samudra Dharshan near Taj hotel, DD Roses gate and Bhavanam Panampilly Nagar, DD Nest, Kathrikadavu & DD west Winds, near Lissie Hospital and now both the above mentioned projects. Please don't make false comments Mr. cheated client.

Then the most important point is they sell apartments at a very very competitive rate. I am requesting all of you to mention their rate per sq ft..and compare it with other builders. I can give you one assurance when you invest something in Desai you will get it for sure, delay may be there, but they don't run away with ur money like some builders do...Regards Ipe.

I had booked an apt in Golden Gate in Dec 2007. IHad paid the full amount then itself. Now, it is delayed by more than 2 years. I don't understand on what basis Mr. Ipe has mentioned that they have started handing over of Golden gate. I had visited the site thrice in the past 6 months. All the three times, I found that sanitary work and second painting is pending. Although majority of the work has been completed in the first 4 towers, it is not yet complete. I found that they have not deployed enough manpower to complete the work immediately. But still, they had been giving 3 months commitment for almost 2 years. Who will shift to an apt which is still under construction? Will somebody think of staying with their kids to a place filled with dust, sand and cement? Who will ensure continous supply of electricity and drinking water? Mr. Ipe should not mislead the customers who have already been cheated. When commenting on something, please check the current position.

I agree that they are competitively priced. At the same time, you should also look at several problems to common man due to this delay. (1) If you are staying in a rented house and is looking for an apt to live, then you lose both EMI and rent. (2) The price of a flat under construction is much lower than a completed flat. So, if somebody looks as an investment, then also he gets hit.

Seems all the dissatisfied customers should unite and file a suit against the builder.

Nobody will give you anything at a price less than what he would've realised, especially Marwadis. Because of poor quality of construction the resale value of their flat is less compared to others. To unite and complain against a builder is not practical, file your complaints individually, then the authorities will take action depending on the number of complaints received. The rent you loose for a flat is minimum 7000 and if the delay is for 3 years, the builder has to compensate you 252,000 which is as per natural justice. If the owners go for legal case they will get it. If the builder is good as Mr.Ipe is telling why dont they declare such compensation and make their customers comfortable. Indiavision was giving news that after Apple, it is Desai. Even otherwise, the owners and the staff in this company with the curse of thousands of poor customers on their head will not be forgiven by God.

The builder may have taken your money to some other state like Apple. Now they are just showing that they are working, but in effect no progress.Otherwise they wouldve completed it early.They complete structure to have a feeling that building is over, but cheating poor customers. Already complaints are being filed at Police station.

I agree to the complaints, I have also made full payment for goldengate 601F but still not delivered. Mails and calls to their office is of any use. Including to their customer care manager Binu and director sanju. They also give false promise and then start avoiding calls. I had tried speaking to Sanju today; same was the fate. Need to join together and take this up. I had already sent a notice and now thinking of taking up all sort of measures possible. We all can join together and form a group in Facebook or Orkut and keep the others posted on the developements.

Just to act as a support for the ongoing issues, My parents also bought property from them which is not yet handed over after 2 yrs. I remember they made major issues of a default payment and even charged interest. And now, even after full payment it is just dead silence. In this present world of social networks, I think we need to stand together and raise voice or else nothing would happen!! I am pretty sure most of the people here are not billioners and have invested their hard earned sweat from middle east and other parts of the worlds thinking they could get something when they come back home. But they seems not to understand. They come over here in the middle east giving brochures and "vagdanams!!"

Apartment story is over atleast in kerala. Now these shamelss guys (not genuine builders; only the builders who are there to loot people's life time savings)can not visit middle east and give brochures and "vagdanams" and get investors. With apple fraud and recent story of incomplete projects (even after 3 years !!!), people have recognized that they are taking a huge risk in investing with them. Also, if we go with the media reports, Govt of India may soon come with real estate regulatory board to screw these guys.Honourable D.G.P of kerala was telling last week that police will start taking tough actions against fraud builders as well will recommend Govt to start awareness programems to make pulic aware of these frauds. and more clients may approach police (to register criminal cases for cheating) and court (for compensation) in future as the tolerance level of clients have reached upper limits. If we go with the recent trend, not only the owners but the managers are also getting caught by legal authorities for giving making false sales promise. Still there is lot of room for good and genuine builders. Unfortunately most of the builders are not realizing the growth potential and going in wrong direction. My sincere advice to the prospective buyers is check the track record & trustworthiness of the builder, have a look at the 100% completed properties and ensure they have all legal clerances (corporation approval, electricity, water, gas, fire etc) before invseting in future. Sadly, you may not find many builders who pass the criteria. Let me tell one thing, Desai Homes is defenitely not a place to park your life time savings. heard builders like National, Skyline, Abad, SFS etc are good. but, not sure whether they will start feeling the pinch with recent developments in real estate.

I have purchased a flat in their Misty Hills project. The agreement reads that the apartments shall be ready by 31-12-2010 plus six months extra time. Now the structure of the building has been completed and started the interiors. But the construction progress is fine as per indian standards. They have completed the complete structure in 30 months time(17+2, two towers). I hope they will finish the project in the next 12 months. I also came to know that they have started giving apartments to owners in the projects mentioned in the complaints. The builder must respond to the complaints raised in the public forums to avoid others to become panic and goverment must take appropriate action before worst happends. It look like the goverment is allowing cheaters to play around with the hard earned money of poor people. I hate the police and legal systems exists in our country , it is just meaningless.

I don't understand your statement like many others. How come you are dealing with them since 1992? Are you working there? Are you sub contracting their work?

You are not an investor/ customer for sure. If you are how come you can justify the delay for 3 years. I own a flat at golden gates and pay an EMI of 15000 and paying rent for 6000 per month. If you are a real investor then you MUST have some similar stories.

Desai homes didn't start the hand over of apartment at Golden gates. Customers are forcing in after the Apple a day collapse. One of the customer was stuck in the lift for 45 minutes last month. They can't leave the kids out to play without "helmets".

Don't be such an idiot if you an investor.
