The applicant has moved this application under Sections 36B(A) and 10A of the Monopolies and Restrictive Trade Practices Act, 1969 against the respondents for indulging in the unfair and restrictive trade practices under Section 36A of the Act.
The brief facts of the case are that the applicant is a Consumer of Tata Sky from 21 November 2008 i.e from the last more than three years and has taken connection by paying in advance the Recharge for the above-mentioned connection at least for one year for Primary and Secondary connection.
The Respondent has been paid Rs 4510/= on 24-Jan-2012 through M/S Happy Satellite & Tlecom, Opp. Amar Guest House, Near Bhagat Singh Chowk, Phagwara Gate, Jalandhar who on the spot transferred the funds to Tata Sky Ltd, and Tata Sky confirmed the receipt of amount vide SMS : SENDER LM-MYTSKY VIDE Message Centre: +919821900022 Sent: 24-Jan-2012 18:50:13 ---The message was: Tata Sky package request completed & current a/c bal: Rs 4541; due date: 21/01/13.
Every now and then Tata Sky indulge in unfair Trade Practices. Now Tata Sky has been providing message that Your Tata Sky ID 1024565093will be deactivate tomorrow at my Registered Mobile No: 94173-06415, whereas Tata Sky’s executives themselves confirmed that my connection will be due on 29/01/2013 vide telephone conversation as well.
Tata Sky is allegedly practicising Monopolisitic Trade Practice as well as Unfair Trade Practice and so the request has been made to initiate enquiry in the matter.
That Tata Sky is harassing the consumer by unnecessarily debiting the amount with tune of Service Charges wheras the fault is at the end of Tata Sky that has provided Cable Wire with joints to the consumer and the joint get loose due to which its connection disrupted but Tata Sky is making fool to the customers in both the way by deducting charges unilaterally and harass consumer by fraudulently threatening to disconnect Tata Sky connection.
The payment has been made only a week back and the company is directing that the Connection will be deactivated. “ULTA CHOR KOTWAL KO DANTE”
Kindly issue necessary directions that when the consumer has paid all the dues before time, then TATA SKY should provide Jointless Cable wire connection to the consumer’s premises. Update the amount with Recharges made and take action against the officials those are playing gimmicks with the consumer.

Due date : 30/01/2012 means the company has hotch-potched all the deposit of Rs 4510/- within 6 days of deposit and again the Due date is being depicted as 30/01/2012 and today is January 31, 2012 means the company has been dodging the consumers from the last so many years which has been highlighted by the consumer time to time, so I posted all the details on Public domain to view the Deficiencies of the Company and fraudulent activities being made by the company.
I submit as under:
BRIEF FACTS
I being the consumer of Tata Sky Ltd hereby submit that due to Defective Cable Wire joint the Primary Connection of our house don’t get regular signal and which used to get disrupted.
That the fault is at the end of Tata Sky that has provided connection to the consumer with joints in Cable wire and due to the Deficient joint the connection got disrupted.
At the time of visit of Company’s mechanic to whom the company describe as Service Engineer the connection was in working condition and as per the complaints made earlier as well that the connection gets disrupted off and on. The fault recovered by your mechanic was that the Tata Sky had provided deficient connection by providing joints in the connection and due to the joints in the Cable wire the problem occur.
As the cable wire provided to the connection has joints so the problem will naturally come of f and on and the company who is duty bound to provide trouble free service to the consumer has charged towards Work Order # 1-13014447598 completed on 30/01/2012 for Rs 200/= which has been charged due to Faulty Cable Wire provided to the consumer by the company with joints. The Company is liable to provide Compensation for regular disruption in the connection due to your Deficiency in Service.
DETAILS
1. The consumer seeks the refund of Rs 200/= charged by Tata Sky due to defective Cable wire provided to the consumer with joints and provide compensation of Rs 50,000/= for Deficiency in Service.
2. The company charged Rs 200/- unilaterally though the consumer has not been intimated before levying charges and consumer had pointed out in his E-mails sent to the company regarding defective service due to off and on signals.
3. When all the technical problems have already discussed by your customer care executive and the fault of Tata Sky has been proved then why the consumer has been levied Rs 200/= charges on unilateral basis.
4. That why not the company provided the details before execution of work regarding charges to be levied if the Tata Sky’s Service will be at fault due to joints in the Tata Sky Cable wire.
5. During the mutual discussions with the Tata Sky executives all the details about the deficient service has been discussed and the Service Engineer who visited our house has confirmed that the connection was working at that time. What it means whether it is consumer’s fault that the Cable Wire with joints has been provided to him and so the company is charging from him due to their fault.
6. In spite of the defective and cable wire with joints have been provided to the consumer the company who is duty bound to provide trouble free service to consumer harass the consumer by charging and not providing compensation for the period in which the connection has been disrupted alongwith mental and physical loss suffered by the consumer.
7. That the reasonable oral and written requests of the consumer having fallen on deaf ears by the company executives.
8. That the facts had been brought to the notices of the company even then the company failed to accommodate and credit the amount charged and replace the Cable wire with joints that has been provided to the consumer.
9. Due to defective connection of Cable Wire the maintenance provided by the company is due to the fault of Tata Sky and the consequential losses suffered by the consumer should be compensated immediately.
RELIEF SOUGHT:
1. The company is requested to provide joint less cable wire connection to the consumer for trouble free service.
2. The company kindly compensate the consumer for the time the connection disrupted and the physical and mental torture in the tune of Rs 50,000/= to avoid further litigation in the matter within 30 days of the serving of notice.
3. The grievances of the consumer has never been resolved by the company as the consumer has been writing to the company from the day of providing connection that the company has provided connection with joints in Cable wire which will bring trouble to the consumer but the company failed to consider the pleadings of the consumer so the consumer kindly be duly compensated.
4. The company is duty bound to provided technical supervision of their jobs done. From the last three years company’s technical supervisor never visited the site to check the connections regarding trouble free service, whereas every Service provider is duty bound to provide Trouble Free Service to the consumer so the compensation kindly be provided to the consumer.

I have recharged the above-mentioned Tata Sky Connection with Rs 4510=00 and got bonus of Rs 15=00 only six days back i.e. on 24/01/2012. After paying amount on annual basis I am still getting technical problem with my Primary connection of Tata Sky. I had made the request to your Tata Sky customer care office on 24th Jan 2012 as well. That day also the Tata Sky connection was not receiving signal. But after lodging complaint the connection got signal. But the problem is still persisting.
I have been facing signal problem for my Tata Sky DTH. I am using this connection from the last three years but from last 1 month or so signals are really bad. Every now and then signal goes off. I had complained with regard to this problem earlier as well. We face more than 100 times such a problem of NO SIGNAL.
Sir, as this problem is due to Tata Sky’s technical problem so I shall not pay charges for your Engineer’s visit. It is proved that Tata Sky was using Foreign Satelite till some time back but from the day they have started providing their own satellite the problem has been manifold.
I am really shocked that the company of repute TATA SKY could not remove the fault after repeated requests. Kindly check your bad quality reception from Satelite immediately to avoid further dispute.
