That the COMPLAINT lodged a complaint dated 22-10-2009 with the MCD to pull down the unauthorized construction, raised at 3rd Floor of the Property bearing No. A-1, situated at Jangpura Extension, New Delhi.
2. That when the MCD failed to take any action, the appellant wanted to know as to why no action has not been taken, he, therefore, moved an application under the Right to Information Act, 2005, praying therein to the MCD to let the applicant/appellant know whether any action has been taken by the MCD in removing the unauthorized construction at 3rd Floor of the Property bearing No. A-1, situated at Jangpura Extension, New Delhi. In its blunt reply, the MCD just said that no action was taken to demolish the unauthorized construction without mentioning any reason as to why no action was taken by the MCD on the complaint of the appellant herein.
3. That the appellant herein filed an appeal before the First Appellate Authority to know that why no action for removing the unauthorized construction was taken by the MCD. Unfortunately, the said appeal did not find favour with the First Appellate Authority, hence this Second Appeal.
